This website is operated by Craft Drinks (a trading name of Lepidus Pty Ltd) (“we”, “us”, “our”). By accessing or using this website and purchasing our products, you agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree to these Terms, you must not use this website.

We may update these Terms from time to time by publishing changes on this page.

2. Legal Capacity & Alcohol Purchases

You must be at least 18 years old to purchase alcohol from this website.

By placing an order, you confirm that:

• you are 18 years or older; and

• you will ensure that the person receiving the delivery is also 18 years or older.

We reserve the right to:

• request proof of age prior to dispatch; and

• require age verification upon delivery.

We may refuse or cancel any order where we reasonably suspect a breach of these requirements.

3. Orders

All orders are subject to acceptance and availability.

We reserve the right to refuse or cancel an order, including where:

• a product is unavailable;

• there is a pricing or listing error;

• we suspect fraudulent or unauthorised activity; or

• the order appears to be for resale or commercial distribution.

If an order is cancelled after payment, a full refund will be provided.

4. Pricing

All prices are listed in Australian dollars (AUD) and include GST unless otherwise stated.

Prices may change at any time prior to order confirmation.

We make reasonable efforts to ensure pricing accuracy, however errors may occur. We reserve the right to cancel orders affected by pricing errors.

5. Products

We specialise in curated craft spirits and boutique gin. Product descriptions are provided to assist purchasing decisions, however:

• variations in colour, packaging, and presentation may occur;

• product availability may change without notice.

6. Consumer Guarantees (Important Notice)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:

• a replacement or refund for a major failure; and

• compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law.

7. Shipping & Delivery

We deliver to most locations within Australia. However, we do not currently deliver to the Northern Territory due to regulatory restrictions relating to the sale and delivery of alcohol.

We reserve the right to:

• refuse or cancel any order where the delivery address is in the Northern Territory;
• cancel orders where delivery is not legally permitted or operationally feasible.

If an order is cancelled due to delivery restrictions, a full refund will be provided.

• Delivery timeframes are estimates only and not guaranteed.

• We are not responsible for delays caused by third-party carriers (including Australia Post).

• Delivery may require a signature and proof of age.

Risk and Title

Risk in the goods passes to you upon delivery.

8. Returns & Refunds

Returns and refunds are governed by our Return Policy, which operates in conjunction with your rights under the Australian Consumer Law.

We accept returns for change of mind as per our Return Policy.

9. Website Use

You must not:

• use the website for unlawful purposes;

• attempt to interfere with the operation or security of the website;

• transmit malicious code or engage in fraudulent activity.

We may suspend or terminate access for breach of these Terms.

10. Third-Party Services

We may use third-party platforms (including Shopify and payment providers). We are not responsible for their independent services, policies, or actions.

11. Limitation of Liability

To the extent permitted by law:

• we are not liable for indirect, incidental, or consequential loss;

• our liability is limited to the replacement or refund of the relevant product, or the cost of doing so.

Nothing in this clause excludes liability where such exclusion is not permitted by law, including under the Australian Consumer Law.

12. Indemnity

You agree to indemnify us against any claims, losses, or damages arising from your breach of these Terms or misuse of the website.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy.

14. Changes to Terms

We may update these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
